The Planning Inspectorate's official statistics for April 2018 to March 2019 show a higher than average rate of success for appellants in the Royal Borough of Kensington and Chelsea with 51% allowed out of 70 appeals; the London Borough of Hammersmith and Fulham with 44% allowed out of 90 appeals; and the London Borough of Barnet with 43% allowed out of a wopping 197 appeals – the highest number for any London Borough in 2018/19.
Not far behind were Tower Hamlets with 40% allowed out of 35 appeals; Redbridge with 38% appeals allowed out of 87 appeals; and Hackney drawing level with 38% appeals allowed out of a total of 85 planning appeals.
The majority of London boroughs had appeal success rates similar to the national average of around 30%, with the following boroughs having between 26% and 35% - Harrow, Waltham Forest, Kingston upon Thames and Wandsworth – all at 26% of planning appeals allowed. Croydon had 27%, Westminster 29%, Hounslow 30% and Lambeth likewise 30% of planning appeals were allowed.
Slightly higher success rates of s78 appeals were found at Bromley (31%), Havering (32%), Hillingdon (32%), Brent (33%), Richmond upon Thames (34%) and Camden (35%).
The London boroughs with low appeal success rates over 2018/19 were Enfield (25%), Greenwich (25%), Sutton (24%), Merton (22%), Ealing (22%), Southwark (21%) and Haringey (21%). Lower still were Lewisham (19%), Islington (19%), Bexley (17%) and Barking and Dagenham (17%). These are well below the national average for the success of a s78 planning appeal.
Two London authorities have almost no hope of success on appeal, namely Newham with only 3 out of 47 planning appeals allowed (6%) and the City of London, with only 1 of 22 planning appeals allowed (5%) in 2018-19.
